Copy Rights

State registration of copy rights allows the author to protect and determine his/her property and personal non-property rights. The rights of authors comprise of personal (non-property) and property rights. Personal (non-property) rights of authors can not be transferred to third parties. Property rights last during the life of the author and 70 years after his death. Such rights are exclusive for use of the author works in any form or way. After expiration of such period the respective author works are transferred to the state and may be freely used as provided by the applicable legislation.

The author and other persons (with the respective author rights), have the right to grant an approval to third parties for the use of the author works by one or any other known ways pursuant to the authorship agreement. The use of author works by any third party is allowed only under the respective agreement, except for situations provided by Articles 21-25 of the Law of Ukraine "On Copyright and Related Rights" (the Copyright Law). The exclusive property right for the employee work belongs to the employer, unless otherwise provided by the labor agreement or any other agreement between employer and employee.

Violations of the author rights or any related rights, which provide for judicial remedies are stipulated by Part 1 of Article 50 of the Copyright Law. Protection of personal (non-property) rights and property rights of authors and subjects of related rights (i.e. performers, producers of video- or phonograms, broadcasting organizations) is implemented by the procedures provided by the administrative, civil and criminal laws of Ukraine.

State registration of copy rights in Ukraine is provided by the Copyright Law.

Objects of the copy right laws are works in the science, literature, and art areas, including:

1. Literature writing works (books, brochures, articles, etc.);



2. Speeches, lectures, and other verbal works;



3. Computer programs;



4. Data basis;



5. Musical works with and without text;



6. Drama, pantomimes, chorographical and other works;



7. Audiovisual works;



8. Pictures, movies, images, paintings, etc.;



9. Architecture, city building works, etc.;



10. Photograph works, etc.;



11. Ceramics, jewelry works, etc.;



12. Illustrations, plans, maps, etc.;



13. Folklore works, etc.;



14. Proceeding works;



15. Literature classic books, encyclopedias, etc.;



16. Texts of the translations of the movies, etc.;



17. Other works.
